• The Competition shall be launched from 29 August 2022 to 28 August 2023.

Acceptance of Terms and Conditions

• By participating in this Competition, all entrants warrant that they have read and understood these Terms and Conditions which are available on the VODACOM website at vodacom.co.ls and VODACOM retail shops.
• By subscribing to the Competition, entrants confirm their voluntary participation and acceptance of these Terms and Conditions and agree:
  • to receive SMS communication from VODACOM on their mobile phones relating to the Competition
  • to receive SMS communication/advertising offers from VODACOM relating to the Competition
• By opting in and participating in the Competition, winners agree that their data, including names, surnames, initials, photos and video images, can be used by VODACOM for advertising purposes.
• These Terms and Conditions shall remain in full force and effect for the duration of the Competition (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).

Eligibility to Participate in the Competition  

• The following persons are eligible to participate in the Competition:
  • Natural persons who are VODACOM subscribers during the Competition, except those specifically excluded under article 1.11 below.

• Excluded persons

            The following persons are excluded from participating in the Competition:

• Employees of VODACOM.
• Immediate family members of the above, being parents, spouses, siblings, and children. Immediate family does NOT include in-laws, close relatives such as cousins, uncles, aunts, nephews and nieces, grandparents, and other extended family members.
• Employees of Competition suppliers
• Non-citizens of the Kingdom of Lesotho who are not legitimately in the country or may fail to provide any documents as may be requested by Vodacom.
• Employees of any company directly collaborating with VODACOM for the purpose of executing this Competition
• Subscribers below the age of 18

• VODACOM reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any provision of the Terms and Conditions.
• By participating in the Competition, entrants hereby warrant that all information submitted is true, current and complete.

Availability and accessibility of information

• All information pertaining to the Competition shall be published on the VODACOM website at vodacom.co.ls and Vodacom social media platforms, and any queries relating thereto shall be submitted to the call center at 114.
• VODACOM reserves the right to cancel or amend the Competition and these Terms and Conditions at any time. Any changes will be made available on the VODACOM website.

Competition Mechanics

• The first three SMSs shall not deduct from the subscribers’ airtime for those who participate through airtime. The fourth SMS and all subsequent SMSes shall deduct from their airtime at a cost of M5.00 per SMS
• Subscribers who participate through airtime shall therefore be at an opportunity to increase their chances of winning by SMSing “WIN” to 52077 over and above their recurring daily ticket subscription
• Subscribers that participate using tickets purchased via USSD and Mega Bundles will not receive free tickets
• All subscribers shall qualify for instant prizes from their first three SMSs each day for the duration of the competition period
• Participation shall qualify all subscribers for all the draws, i.e., the instant draw, daily draw, monthly draw, and the jackpot draw
• The more tickets a subscriber uses the more they shall increase their chances of winning
• Subscribers shall be able to participate through the designated channels concurrently
• Subscribers shall be able to purchase multiple USSD and/or mega bundle tickets
• Their ticket usage (SMSes) count shall be cumulative
• Winners shall be selected through random draws
• Instant prizes shall be on offer on a daily basis. Subscribers shall receive an SMS upon usage of their first three tickets of each day informing them whether they have won the instant prize or not. The first ticket shall qualify a subscriber for the first instant prize, the second ticket for the second instant prize, and the third ticket for the third instant prize.
• There shall be one winner per draw
• Prizes shall be delivered through the winners’ bank accounts as confirmed by them.
• Unbanked subscribers may select M-pesa payment for prize delivery
• Winners shall receive their prizes within 30 working days
• The airtime and payments costs incurred from participating in the competition shall not be recoverable
• Subscribers may be awarded free tickets based on their participation.

• Prizes
  • Subscribers shall stand a stand to win cash under the instant, daily, monthly, and/or the jackpot draw.

2. Notices and Redemption of Prizes
   • All winners shall be contacted by VODACOM via SMS and/or a phone call to their MSISDN number used to participate in the Competition.
   • All winners will receive notices relating to the draws
   • Winners shall be required to provide their identification documents in order to receive their prizes
   • If a winner cannot be contacted within thirty (30) working days from the draw date, or a notified winner refuses the prize or fails to appear to collect it within thirty (30) working days of notification, they shall forfeit the prize.
   • Prizes shall not be transferable.
3. Limitation of liability
   • VODACOM accepts no responsibility whatsoever including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution.
4. Disclaimer of warranties
   • Participants understand and agree that they participate in this Competition at their own risk and willingness and have not been coerced in any manner to enter.
   • VODACOM makes no warranty, implied or express, that any part of the Competition will be uninterrupted and error-free.
   • Neither VODACOM nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the Competition or as a result of accepting the prize.
   • VODACOM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials associated with the Competition .
   • By entering the Competition, entrants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against VODACOM, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage.
5. Data Protection and Publicity
   • Personal data related to voice, image, names or address and any other relevant information obtained in connection with the Competition will be used in a manner and in line with the Vodacom Privacy Management Policy.
   • VODACOM shall not release personal information about participants of the Competition to third parties unless required to do so in compliance with the governing law.
6. Suspension and termination of the Competition
   • VODACOM reserves the right, whenever deemed necessary, to temporarily suspend the Competition for operational reasons (e.g. for repairs, planned maintenance or upgrades) and undertakes to restore same as soon as possible after any temporary suspension period.
   • Interruption or early termination of the Competition shall not release VODACOM from its obligation to give out already awarded prizes and execute all other actions required to give effect to such except for the cases when termination or interruption of the Competition resulted from actions or events which are not under VODACOM’s control.
   • VODACOM shall notify subscribers of any termination or suspension of the Competition
7. Dispute Resolution
8. VODACOM’s decision regarding the Competition and /or Terms and Conditions shall be final.
   • In any case of disagreement or disputes relating to Vodacom’s decision, participants shall lodge their complaints with VODACOM for amicable resolution of the same which shall be settled through private good faith negotiations.
   • If the dispute is not resolved within fourteen (14) working days of an attempt to resolve such or the aggrieved party is not happy with the outcome, then he/she shall lodge a complaint with the Lesotho communications Authority and shall further be at liberty to exercise any other rights or remedies in law.
