Vodacom Mega Games Competition

  4. Duration of the Competition
    1. The Competition shall be launched from 19 February 2024 to 18 February 2025.

  5. Acceptance of Terms and Conditions
    1. By participating in this Competition, all entrants warrant that they have read and understood these Terms and Conditions which are available on the VODACOM website at www.vodacom.co.ls and VODACOM retail shops.
    2. By subscribing to the Competition, entrants confirm their voluntary participation and acceptance of these Terms and Conditions and agree:
      1. to receive SMS communication from VODACOM on their mobile phones relating to the Competition
      2. to receive SMS communication/advertising offers from VODACOM relating to the Competition.
    3. By subscribing to and participating in the Competition, winners agree that their data, including names, surnames, initials, photos, and video images, may be used by VODACOM for advertising purposes.
    4. These Terms and Conditions shall remain in full force and effect for the duration of the Competition (not taking into account temporary suspensions of the offer for operational reasons, e.g., for repairs, planned maintenance or upgrades).

  6. Eligibility to Participate in the Competition
    1. The following persons are eligible to participate in the Competition:
      1. Natural persons who are VODACOM subscribers during the Competition, except those specifically excluded under article 7.1 below.

  7. Excluded persons.
    1. The following persons are excluded from participating in the Competition:
      1. Employees of VODACOM.
      2. Immediate family members of the above, being parents, spouses, siblings, and children. Immediate family does NOT include in-laws, close relatives such as cousins, uncles, aunts, nephews and nieces, grandparents, and other extended family members.
      3. Employees of Competition suppliers
      4. Non-citizens of the Kingdom of Lesotho who are not legitimately in the country or may fail to provide any documents as may be requested by Vodacom.
      5. Employees of any company directly collaborating with VODACOM to execute this Competition.
      6. Subscribers below the age of 18
    2. VODACOM reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any provision of the Terms and Conditions.
    3. By participating in the Competition, entrants hereby warrant that all information submitted is true, current, and complete.

  8. Availability and accessibility of information
    1. All information pertaining to the Competition shall be published on the VODACOM website at www.vodacom.co.ls and Vodacom social media platforms, and any queries relating thereto shall be submitted to the call center at 114.
    2. VODACOM reserves the right to cancel or amend the Competition and these Terms and Conditions at any time. Any changes will be made available on the VODACOM website.

  9. Competition Mechanics
    1. Subscribers shall be able to participate in a competition through the specific channels and Vodacom reserves the right to change channels.
    2. They are free to unsubscribe from the Competition at any time by sending “STOP” to 57022, or through the designated USSD Code *777# and selecting “Unsubscribe”.
      Ticket Purchases and Participation
      Single Ticket purchase
      1. Subscribers shall purchase a single ticket by dialling *777#, at a once-off cost of M5.00 and shall select the “play once” option.
      2. The ticket purchase (s) is/are made using airtime or M-Pesa.
      3. Thereafter subscribers shall use their ticket by SMSing “WIN” to 52077 to participate in any competition that runs on Mega Games.
      Multiple ticket purchase and participation
      1. Subscribers shall make multiple-ticket purchases by dialling *777# and will be presented with a menu and cost of the available batches of tickets.
      2. The multiple ticket purchase shall be made using airtime or M-Pesa.
      3. They shall thereafter participate in a competition by SMSing “WIN” to 52077.
      Recurring subscriptions
      1. Subscribers shall make a recurring subscription by dialling *777# and selecting “subscribe and play”, or by sending WIN to 52077.
      2. The subscription shall recur until a subscriber opts outs.
      3. M5.00 airtime shall be deducted daily from a subscribers’ airtime for the subsistence of their subscription.
      4. Where a subscriber does not have sufficient airtime, they will not be able to participate, and the recurring subscription shall continue once they have a positive airtime credit.
      5. First-time subscribers using the Recurring Subscription channel will receive 3 free SMSs to use to encourage participation.
      Mega Bundles
      1. Subscribers shall make ticket purchases through the voice and data bundles.
      2. They shall participate in the game by SMSing “WIN” to 52077.
    3. Vodacom may apply M1, M2, M3, and M4 discounts on ticket purchases or subscriptions.
    4. Subscribers may be awarded free tickets based on their participation.
    5. The airtime and payment costs incurred from participating in the Competition/s shall not be recoverable save for where this is caused by fault of Vodacom in which case the customer will be refunded.
    6. Prizes
      1. Subscribers shall stand a chance to win instant and daily cash prizes and/or grand prizes in the form of immovable property quarterly under the instant, daily, and grand prize draws. The first SMS usage shall qualify a subscriber for the first instant prize, the second SMS for the second instant prize, and the third SMS for the third instant prize. The prizes are outlined in Table 1.
      2. They shall stand a chance to win instant prizes from their first three tickets usage of the day.
      3. Subscribers shall receive an SMS upon usage of the first three tickets informing them whether they have won the instant prize or not.
      4. Winners shall be selected randomly for each draw and each subscriber can only win once from each draw.
      5. The grand prize shall take place quarterly, i.e., every three months.
      6. Where a subscriber wins the grand prize in an instant draw during a specific quarter, there will be no grand prize draw during that quarter.
    7. Cash Prizes shall be delivered through the winners’ bank accounts or M-Pesa.
    8. Cash prizes shall be delivered within 7 to 30 working days after the winners’ announcement.
    9. The grand prize shall be delivered within 3 months following a winner announcement. The three months will allow for logistical tasks related to the handover of immovable property and other dependent factors, conditions, and approvals from relevant Authorities outside of our control.
    10. If a winner is unreachable after 30 working days of attempted contact, they shall forfeit their prize.
    11. Prizes shall not be transferable.
    12. Where a subscriber does not meet the eligibility criteria or is unreachable for their prize delivery as specified in 9.7.9 and 9.7.10 above, there shall be substitute winners.
    13. Winners shall be verified through their identification documents to receive their prizes.

  10. Notices and Communication to Winners
    1. All winners shall be contacted by VODACOM via SMS and/or a phone call to their MSISDN number used to participate in the Competition.
    2. If a winner is unreachable after 30 working days of attempted contact, they shall forfeit their prize.
    3. Winners will be announced on the Vodacom Facebook social media page.

  11. Limitation of liability
    1. VODACOM accepts no responsibility whatsoever including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution.

  12. Disclaimer of warranties
    1. Participants understand and agree that they participate in this Competition at their own risk and willingness and have not been coerced in any manner to enter.
    2. VODACOM makes no warranty, implied or express, that any part of the Competition will be uninterrupted and error-free.
    3. 12.3 Neither VODACOM nor any of its directors, employees, agents, or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the Competition or as a result of accepting the prize.
    4. VODACOM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials associated with the Competition .
    5. By entering the Competition, entrants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against VODACOM, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage.

  13. Data Protection and Publicity
    1. Personal data related to voice, image, names or address and any other relevant information obtained in connection with the Competition will be used in a manner and in line with the Vodacom Privacy Management Policy.
    2. VODACOM shall not release personal information about participants of the Competition to third parties unless required to do so in compliance with the governing law.

  14. Suspension and termination of the Competition
    1. VODACOM reserves the right, whenever deemed necessary, to temporarily suspend the Competition for operational reasons (e.g., for repairs, planned maintenance or upgrades) and undertakes to restore same as soon as possible after any temporary suspension period.
    2. Interruption or early termination of the Competition shall not release VODACOM from its obligation to give out already awarded prizes and execute all other actions required to give effect to such except for the cases when termination or interruption of the Competition resulted from actions or events which are not under VODACOM’s control.
    3. VODACOM shall notify subscribers of any termination or suspension of the Competition.

  15. Dispute Resolution
    1. In any case of disagreement or disputes relating to Vodacom’s decision, participants shall lodge their complaints with VODACOM for amicable resolution of the same which shall be settled through private good faith negotiations.
    2. Our Complaints Handling Procedure, as covered in the Vodacom Consumer Protection Code, shall apply to any complaints arising from this competition. The Code is available on our website www.vodacom.co.ls
    3. These terms and conditions will be construed, interpreted, and enforced in accordance with the laws of Lesotho.
